PORTLAND, Maine – Kelly McDonald has earned the Maine State Bar Association’s Vincent L. McKusick Award for 2013 for his article, “Attachment On Trustee Process: A Primer For The Practitioner.” McDonald is an attorney at Murray, Plumb & Murray.
The Maine Bar Journal Editorial Advisory Committee presents the Vincent L. McKusick Award annually for the best article published in the preceding year. The Vincent L. McKusick Award is named after former Chief Justice McKusick.
Trustee process is a way for a plaintiff in a lawsuit to place a lien on a defendant’s assets at the beginning of a case to ensure that there will be money to pay a judgment. McDonald’s article is the culmination of several years of research reviewing all of the Maine cases from the time Maine first became a state involving trustee process. McDonald refined that collection of cases into the article, a mini-treatise on the subject. Since publishing the article McDonald has taught several CLEs on the subject.
McDonald joined Murray, Plumb & Murray in 2005 and became a partner in 2013. He litigates many different types of cases in both state and federal court including commercial, real estate, construction disputes, land use, bankruptcy (creditor’s rights), and products liability litigation.
He serves as chair of the MaineShare board and chair of the Police Citizen Review Subcommittee for the City of Portland. He is also a member of the American Civil Liberties Union of Maine Legal Panel and a member of the Maine Motor Transport Association board. He has provided pro bono litigation services to dozens of victims of domestic abuse to help them obtain protection orders.
He is a graduate of the University of Virginia Law School, where he received awards for best oral argument and for his pro bono work. He received his bachelor of arts in mathematics and philosophy from Bates College.
